FALL SAFE® intends to inform its Clients, Users, Suppliers and Employees of the general rules for the processing of personal data, which are collected and processed in strict respect and compliance with the provisions of the personal data protection legislation in force in each country. moment, namely Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, hereinafter referred to as GDPR.

FALL SAFE® is committed to the protection and confidentiality of personal data, having adopted the measures it deems appropriate to ensure the accuracy, integrity and confidentiality of personal data, as well as all other rights that assist the respective holders. The rules provided for in this Data Protection Policy complement the provisions, regarding the protection and processing of personal data, provided for in the contracts that Customers, Users, Suppliers and Collaborators celebrate with FALL SAFE®, as well as the rules provided for in the terms and conditions that regulate the provision of services and that are duly publicized on the respective website.

WHAT DOES THIS DATA PROTECTION POLICY COVER?
This Data Protection Policy applies exclusively to the collection and processing of personal data for which FALL SAFE® is responsible for the respective treatment, within the scope of the services provided to its Customers, Users, Suppliers and Collaborators and in all situations in which personal data is processed by FALL SAFE®. The FALL SAFE® website may include access links to other websites that are unrelated to FALL SAFE®. The provision of such links is made in good faith, and FALL SAFE® cannot be held responsible for the collection and processing of personal data carried out through these websites, nor does FALL SAFE® assume any responsibility in relation to such websites, namely regarding their accuracy , credibility and functionalities made available in them.

WHAT ARE PERSONAL DATA?

The data protection officer plays a relevant role in the processing of personal data, ensuring, among other aspects, compliance of data processing with the legislation in force, verifying compliance with this Data Protection Policy and defining clear rules of processing of personal data, ensuring that all those who entrust it with the processing of their personal data are aware of how FALL SAFE® treats them and what rights they have in this matter.

WHAT PERSONAL DATA IS PROCESSED? FALL SAFE®, within the scope of the activities it develops, processes the personal data necessary for the provision of services, processing data such as name, address, telephone number and email address, according to more detailed information made available to users.personal data holders.If there is prior consent from the Customer, User, Supplier or Collaborator, this may be withdrawn at any time, without, however, compromising the lawfulness of the treatment carried out based on the previously given consent.

WHEN AND HOW DO WE COLLECT YOUR PERSONAL DATA?
 FALL SAFE® collects your personal data, namely by telephone, in writing, email, through its websites, applications and through the Customer area, guaranteeing, whenever necessary, the prior consent of the holder of the personal data.Some personal data are indispensable for the execution of the contract and, in case of lack or insufficiency of the same, FALL SAFE® will not be able to provide the product or service in question.If the holder of the personal data is not a Customer, User, Supplier or Collaborator of FALL SAFE®, the respective personal data will only be processed when they are made available, namely by subscribing to the sending of newsletters, in which case the rules of this Privacy Policy will apply.Data Protection.The personal data collected can be processed by computer and in an automated or non-automated way, guaranteeing in all cases strict compliance with the legislation on the protection of personal data, being stored in specific databases, created for this purpose and, under no circumstances,the data collected will be used for a purpose other than the one for which they were collected or given consent by the data subject.

WHAT ARE THE PURPOSES OF PROCESSING PERSONAL DATA AND THEIR LEGAL BASIS?
In general, the personal data collected is based on and intended for the management of the contractual relationship, the provision of contracted services, the adequacy of services to the needs and interests of the Customer, User, Supplier or Employee, namely for the purpose of accessing functionalities service-specific. Additionally, personal data may also be processed for the purposes of complying with legal obligations and for the purposes of investigation, detection and repression of serious crimes.

HOW LONG DO WE KEEP YOUR PERSONAL DATA?
The period of time during which personal data is stored and maintained varies according to the purpose for which the information is processed. Indeed, there are legal requirements that oblige to keep data for a minimum period of time. Thus, and whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary to pursue the purposes that motivated its collection or subsequent processing, under the terms defined by law.

As holders of personal data, Customers, Users, Suppliers and Employees are guaranteed, at any time, the right to access, rectify, update, limit and erase their personal data (except for data that are indispensable for the provision of services by FALL SAFE® duly identified on the Form as being mandatory supply or compliance with legal obligations to which the controller is subject), the right to object to their use for commercial purposes by FALL SAFE® and to withdraw consent, without that this compromises the lawfulness of the processing carried out under that consent, as well as the right to data portability.

HOW CAN YOU ACCESS, RECTIFY, UPDATE, LIMIT, DELETE, OPPOSITE THE TREATMENT OF YOUR PERSONAL DATA, OR REMOVE CONSENT?
Without prejudice to the provisions of the RGPD, the holder of the personal data may do so, directly or upon written request, addressed to the respective Responsible for the treatment, through the contacts made available for this purpose in this document, as well as other contacts made available by FALL SAFE ®.

HOW CAN YOU OBJECT RECEIVING CONTACTS FOR MARKETING PURPOSES?
FALL SAFE® may promote actions to disseminate new products or services to its Customers, Users, Suppliers and Employees, namely via telephone, e-mail, SMS, MMS or any other electronic communications service, if the holder of the personal data has given the respective consent. If the holder of personal data does not wish to continue receiving these communications, he may, at any time, withdraw his consent to the use of his data for marketing purposes.

HOW CAN YOU COMPLAIN?
Without prejudice to being able to present complaints directly to FALL SAFE®, through the contacts made available for this purpose, the Customer, User, Supplier or Employee can complain directly to the Control Authority, which is the National Data Protection Commission (CNPD), using the contacts made available by this entity for this purpose.

WHAT ARE THE MEASURES ADOPTED BY FALL SAFE® TO ENSURE THE SECURITY OF YOUR PERSONAL DATA?
FALL SAFE® is committed to guaranteeing the protection of the security of the personal data made available to it, having approved and implemented strict rules in this matter. Compliance with these rules is an obligation for all those who legally access them. Bearing in mind the concern and commitment that FALL SAFE® reveals in the defense of personal data, several security measures were adopted, of a technical and organizational nature, including encryption and authentication tools to help protect the personal data made available to it against its dissemination, loss, misuse, alteration, treatment or unauthorized access, as well as against any other form of illicit treatment. Additionally, third parties that, within the scope of the provision of services, process the personal data of the Client, User, Supplier or Collaborator in the name and on behalf of FALL SAFE®, are obliged, in writing, to carry out technical and adequate security that, at all times, meet the requirements set out in the legislation in force and ensure the defense of the rights of the data subject (namely, the protection of the privacy and personal data of Customers, Users, Suppliers and Employees). Although the transmission of data via the internet or website cannot guarantee complete security against intrusions, we and our service providers make the best efforts to implement and maintain physical, electronic and procedural security measures aimed at protecting your personal data in compliance with applicable data protection requirements. Among others, we implemented the following:
- Restricted personal access to your personal data based on the “need to know” criterion and only within the scope of the communicated purposes;
- Transfer of collected data only in encrypted form;
- Protection of information technology systems through firewalls, in order to prevent unauthorized access to your personal data;
- Permanent monitoring of access to information technology systems with a view to preventing, detecting and preventing the misuse of your personal data.
Notwithstanding the security measures adopted by FALL SAFE®, FALL SAFE® warns all those who browse the Internet that they must adopt additional security measures, namely, ensure that they use a PC and a Browser updated in terms of "patches" of properly configured security, with an active firewall, antivirus and anti-spyware and that ensure the authenticity of the sites they visit on the Internet, and should avoid websites whose reputation they do not trust.

IN WHICH CIRCUMSTANCES DOES DATA COMMUNICATE TO OTHER ENTITIES (THIRD PARTIES AND SUBCONTRACTORS)?
FALL SAFE®, within the scope of its activity, may use third parties to provide certain services. Sometimes, the provision of these services implies access, by these entities, to the personal data of the parties. When this happens, FALL SAFE® takes the appropriate measures, in order to ensure that the entities that have access to the data are reputable and offer the highest guarantees at this level, which is duly enshrined and safeguarded contractually between FALL SAFE® and the third party(ies). Thus, any entity subcontracted by FALL SAFE® will process the personal data of our Customers, Users, Suppliers and Collaborators, in the name and on behalf of FALL SAFE® and adopting the necessary technical and organizational measures in order to protect personal data against destruction, accidental or unlawful, accidental loss, alteration, dissemination or unauthorized access and against any other form of unlawful processing. In any case, FALL SAFE® remains responsible for the personal data made available to it.

UNDER WHAT CIRCUMSTANCES DO WE TRANSFER YOUR PERSONAL DATA?
The provision of certain services by FALL SAFE® may imply the transfer of your data outside Portugal, including outside the European Union or to International Organizations. In such case, FALL SAFE® will strictly comply with the applicable legal provisions, namely regarding the determination of the suitability of the country(ies) of destination with regard to the protection of personal data and the requirements applicable to such transfers, including, always where applicable, the signing of appropriate contractual instruments that guarantee and respect the legal requirements in force.
